Does Texas' Ban on Marriage Make All Marriages Illegal? |

Democratic candidate for Texas' Attorney General Barbara Ann Radnofsky sees the state's over-arching ban on marriage equality as affecting more than just its GLBT population. “This state or a political subdivision of this state may not create or recognize any legal status identical or similar to marriage.” she said yesterday. “I believe the clear language of (Subsection) B bans all marriages, and this is indeed a huge mistake. You don’t have to have a fancy law degree to read this and understand what it plainly says.”
Whether or not others interpret the archaic and very un-American ban in the same light has yet to unravel, but Radnofsky's fear that it's vague language might inspire future (and unnecessary) court cases regarding insurance, property, custody, etc., doesn't exactly mean she's pro-gay. It seems at this point, as a candidate for a high-profile office in Texas of all places, Radnofsky's might be more concerned with saving the state from wasteful spending rather than abandoning a law that creates different classes of rights for Texans.
