Ninth Circuit Anticipates Prop 8 Videotape Ruling On Thursday PDF Print

The Ninth Circuit Court of Appeals expects to issue its ruling on the public release of the Prop 8 trial videotapes on Thursday, February 2 by 10 a.m. PST. More details, after the break.

Metro Weekly's always-astute Chris Geidner has studied the fine print in the court's note, which reads, in part that Thursday's filing will not involve "the main appeal regarding the constitutionality question."

Writes Geidner, "That note itself is interesting, for the Ninth Circuit panel that is hearing the appeal of Perry v. Brown is considering the standing question, whether Walker needed to recuse himself because of his relationship with a same-sex partner and the constitutionality question. Although the office could have simply been using shorthand to reference the Perry v. Browncase, it is noteworthy that, if the court found the proponents to lack standing, the court would not need to reach "the constitutionality question."

The announcement opens up an opportunity for Prop 8 supporters (who are against having the tapes released, go figure) to file for an emergency stay on the decision today.
