Utah Asks U.S. Supreme Court To Halt Same-Sex Marriages

Utah has officially asked the U.S. Supreme Court to halt same-sex marriages, which were recently legalized in the state

The Associated Press reports:

Utah took its fight against gay marriage to the U.S. Supreme Court on Tuesday, asking the high court to suspend same-sex unions that became legal when a judge struck down the state's voter-approved ban.

The heavily Mormon state wants the marriages to stop while it appeals a judge's decision, which said banning gay couples from marrying violates their right to equal treatment under the law.

In papers filed Tuesday with Justice Sonia Sotomayor, the state asked her to overturn court decisions to let the marriages go forward. Sotomayor handles emergency requests from Utah and other Rocky Mountain states. She can act by herself or get the rest of the court involved.

"Numerous same-sex marriages are now occurring every day in Utah," Utah lawyers complain in the filing. "Each one is an affront not only to the interests of the state and its citizens in being able to define marriage through ordinary democratic channels, but also to this court's unique role as final arbiter."

Utah repeatedly stressed that states have the authority to define marriage as between a man and woman. "That states have a powerful interest in controlling the definition of marriage within their borders is indisputable," Utah said in the filing.

How do you think will Justice Sotomayor will handle the state's request?

Just a thought, don't leave anything to chance, Utah Instincters! Get those marriages locked down now!

I hope God will be on the side of the gays and lesbians. I think they have endured enough already and it's time to show the aliens that we really are "civilized"

It's got to be obvious to the AG that he'll lose this based on the DOMA/Prop 8 precedent. But his constituency wouldn't allow him to do otherwise - he'd lose this year's election if he didn't defend it vigorously.. But it continues to be very disturbing that a protector of the people's rights is putting the will of the majority above protecting minority rights, as if the Equal Protection Clause of the Constitution didn't exist. When I was in elementary school, I learned that democracy = majority rules + minority rights. I guess many folks in the U.S. have forgotten that.

I trust that since the Supreme Court has already thrown out DOMA that Justice Sotomayor will do the right thing and throw this case out of court.

I am so hoping she will deny the request and allow all Utah citizens the same and equal rights under the constitution...
