Florida Keys Judge Overturns State's Same-Sex Marriage Ban

Florida's same-sex marriage ban has been struck down by a judge in the Florida Keys, but the decision will only affect marriages in a single Florida county.

The Associated Press reports:

A judge in the Florida Keys has overturned the state's constitutional ban on same-sex marriage after a legal challenge by six gay couples said it effectively made them second-class citizens.

The ruling was issued Thursday by Circuit Judge Luis M. Garcia and applies only to Monroe County, which covers the Keys. The lawsuit contended that the same-sex marriage ban approved by voters in 2008 violated the U.S. Constitution's guarantee of equal protection under the law. The judge says licenses could be issued starting Tuesday.

Florida's Attorney General Pam Bondi has already expressed support for keeping the state's same-sex marriage ban in place.

Looks like Pam Bondi AG of Florida is the Anita Bryant of 2014.

Only one county was a defendant. However, there's no rule that FL residents must get their marriage license in their home county, so the option will be available to the rest of the state's gay couples. And because both people must be present to get the license, the barrier of say Pensacola residents traveling all the way to Key West adds another argument for the remaining state case and the federal case.

It is only that county because it did not got to the FL Supreme Court in Tallahassee yet. And yes Florida laws suck. Been trapped hear for 20 years.

Why on earth would it only apply to a single county? This is a new one.

its only one county because Florida is one of the most backwards states in the country.

This is a difficult question because while South Florida is more gay friendly and open to diversity, North Florida is influenced by the Southern states and resistant to diversity. The Capitol is Tallahasee, influenced by the South. That will create friction.
