BREAKING: Federal Judge Strikes Down Utah's Same-Sex Marriage Ban

A federal judge in Utah Friday struck down the state’s ban on same-sex marriage, saying the law violates the U.S. Constitution’s guarantees of equal protection and due process.

"The state’s current laws deny its gay and lesbian citizens their fundamental right to marry and, in so doing, demean the dignity of these same-sex couples for no rational reason," wrote U.S. District Court Judge Robert J. Shelby. "Accordingly, the court finds that these laws are unconstitutional."

Shelby’s ruling came just 16 days after he heard arguments in the case and well before his self-imposed deadline to render a decision by Jan. 7, when the next hearing in the matter was to be held.


Shelby said that while he agreed with Utah that marriage has traditionally been left to regulation by the states, such laws must comply with the Constitution.

"The issue the court must address in this case is not who should define marriage, but the narrow question of whether Utah’s current definition of marriage is permissible under the Constitution," the judge said.

Shelby acknowledged the politically charged climate that surrounds the issue and said that was particularly true in Utah, where 66 percent of voters approved the amendment banning same-sex marriage in 2004.

"It is only under exceptional circumstances that a court interferes with such action," Shelby said. "But the legal issues presented in this lawsuit do not depend on whether Utah’s laws were the result of its legislature or a referendum, or whether the laws passed by the widest or smallest of margins."


Hey please don't trash other peoples spiritual beliefs. The Mormons see it that the biggest reason to be here is to have children and so gay love makes no sense to them, not unlike a million other Christian Churches, they have reached out to the LGBT community..durring Pride in Salt Lake some marched in the parade with us, and I know I was raised Mormon and am a son of the pioneers...but also Native American have been raised with distinct cultural beliefs and I am gay and I am here in Utah, with my Partner and our son, and our five pit bulls and an african grey parot and WE ARE A FAMILY....we moved two years ago and have been treated AMAZINGLY and loving by everyone we have met....and accepted with great love and understanding by my Mormon family. Were from Washington State, and Gay marriage was just made legal there, and so we are completely surprised this has happened here and grateful to God and ALL the people who support us now...Mormon and Non.

These news are amongst the best of news, the most excellent of news.  No other news could hold a candle to these news God willing.

I guess it's okay to be gay or lesbian but not okay to be mormon? I don't radiate towards any religion, but to me I find the insulting of a person for following their personal religious beliefs equal to doing the same towards their sexual preference. I guess that's logic though, something that seems to be lacking in our culture these days.

FYI, it's not a sexual "preference".  A preference is a choice.  This is how we were born.

I'm Mormon and am very excited about this step forward for Utah. I have and always will support the LGBT community. Thanks for insulting me.

I do that too; the whole mor(m)on- thing.  'course, all religion is for mor(m)ons... but their's just happens to be "lucky" enough for the word- play ;-)
