Federal Judge Strikes Down Texas Ban On Marriage Equality
In a major victory for civil rights, U.S. District Judge Orlando Garcia ruled on Wednesday that Texas’ ban on marriage for lesbian and gay couples is unconstitutional.
In his decision, Judge Garcia writes that the Texas State Constitutional Amendment approved by voters in 2005 banning marriage equality denied same-sex couples equal access under the law and demeaned their dignity "for no legitimate reason."
"Without a rational relation to a legitimate governmental purpose, state-imposed inequality can find no refuge in our United States Constitution," the federal judge wrote.
Judge Garcia issued a stay along with his decision as an appeal by the state's lawyers is expected.
