New Mexico Judge Orders Two Counties To Issue Marriage Licenses To Same-Sex Couples

A huge victory has just been announced in New Mexico where Judge Alan Malott ruled that state law does not bar gay couples from getting married.

Malott ruled that the Bernalillo and Santa Fe county clerks must grant marriage licenses to gay couples who apply for them. The court ruling concerns a lawsuit filed on behalf of three lesbian couples who said the state constitution has no explicit ban on marriage rights for same-sex couples.

Bernalillo County will start issuing licenses to gay couples on Tuesday. The clerk's computers must be reconfigured. Santa Fe County started issuing licenses to same-sex couples last week after a judge there ordered the county clerk to do so. A few days before that, the Dona Ana County Clerk starting issuing licenses to gay couples after he said the state law didn't prohibit it.
