Student Suspended From High School For Gay Porn Work, Won't Graduate

The Brevard County School District has announced that gay porn performer, "Noel" (real name, Robert Marucci) will be allowed to return to Cocoa High School on Wednesday. They also deny that he was ever suspended for his porn work.

The school district denies both the student and his mother’s on camera claims that he was expelled because of his role in gay porn, and said the ‘real’ reason he was told to stay home and issued a referral slip was because of “credible allegations” the staff received.

“We had an investigation, which is now complete, and the student is welcomed to come back to talk to Dr. Sullivan about his educational options,” said Michelle Irwin, a spokesperson for the district.

However, when we asked the exact reason for the student’s suspension, Irwin couldn’t say, citing privacy laws.

“No child would ever be suspended for a job that they have outside of the school environment,” said Irwin.

Victory?? If "Noel" has proof of his original claim that he was suspended for his adult film work, we still think he should sue. But maybe we're just petty that way!

A Reddit user has reported that Sean Cody gay porn performer "Noel" has been suspended from his Florida high school for ten days following the reveal that he'd participated in gay pornography.

That ten day suspension results in an immediate "failure from absences," so "Noel" won't be graduating from Florida's Cocoa High School. 

The Reddit user writes:

Anyway, my cousin is a schoolmate with the model who plays Noel. Apparently this last week word got out around the school that he was in gay porn. He got severely bullied and, instead of helping him, the school will not let him graduate due to him causing a "campus disturbance". They suspended him for 10 days, which leads to an automatic FA (failure from absences).

Several students planned to protest by wearing support shirts, making posters, and skipping a class. The principle is threatening to automatically expel any student who joins in.

In case you're wondering, Cocoa is a public high school and "Noel" was apparently of legal age when he performed for Sean Cody.

We were able to find “Noel’s” public Facebook account and can confirm he was indeed suspended from CHS. On Friday, he responded to a friend on facebook by saying: “Coming back to Cocoa isn’t the best for me but bringing justice to the disciplinary system and discrimination of the administration has not slipped my mind either!"

He's received support from hundreds of students via Facebook and actual student protest, with some students skipping their seventh period class to march on behalf of "Noel":

"Noel", is 18 and can do whatever he wants. The school just didn't want the stigma of having a "pornstar" enrolled and didn't know how to respond. He's most certainly not to first to do porn at 18, but at least he is of age unlike other stars who were not (Cobra star). I just hope he's not hurt at the school because of this. However, it does bother me that his mother is so causal about her son being sexually penetrated on cam to help her do what "she" is responsible for.

The news here didn't mention anything about gay porn they just said porn.

Besides, that doesn't matter, the boy did nothing wrong to warrant that kind of treatment.

There was news that he was involved in a gay porn. He did a few videos for a site called Sean Cody which is a predominantly gay pornography web site

The young man has returned to school and has talked to CNN. He is personable, and his side of the story seems believable, but it does lack specifics.  My guess is the school wanted to remove what I'm sure was a problem and took the path of least resistance by suspending him and when national media learned of the story,along with legal advice, decided the young man could return. The young man's mother also speaks, stating she supported his decision and was proud he stepped up to be the "man of the family" and earn money when she wasn't stepping up to the plate. Part of me thought she was just defending her son, as any mother would do, but it did not come across that way.Now I feel sorrier for the young man than I did before his appearance on CNN. I still believe he's being exploited by Sean Cody, who never should have cast a high school student not matter what the age, and from what I understand proudly uses this fact in advertising, and if the CNN clip is authentic, perhaps by his family. I know what he did was legal, I more than understand free speech issues, and I did not agree with the suspension. I think we've forgotten a person is involved and from what I see, a presumably gay young man acted in porn flicks, with family support so bills could be paid, was outed in school and bullied and faced with the possibility of not graduating, and to me he's first and foremost a kid. He's better looking that I was at that age, and I'm more than willing to be that if I visited Sean Cody's website, I'm sure I'd be impressed with what we don't see in the photo provided, but I'd always see an exploited kid, much as I do when I see Sean Paul Lockhart, a.k.a Brent Corrigan and always remember he was 17 when he got started. this is the type of thing that feeds the" homos are pedophiles" rhetoric!  As for him being expelled for doing porn (not necessarily "gay porn", it seems that whether a boy or girl, anyone doing porn while still in high school probably would be considered a genuine & legitimate safety concern for any school. (imagine what a young girl involved in porn would endure from classmates, same for a young boy, especially one doing gay porn)

Reddit has been known to jump to conclusions before (e.g., Boston bombing suspects). Maybe this kid was suspended for some reason other than his porn acting. The "reporting" around this has been rather light, so there could easily be much more to the story.

@ Stephanie Donald being a lesbian doesn't mean that your not homophobic nor does it mean that your not sex-negative; the worst bulling that I received in high school (and the workplace) was from self-hating closeted gay men.

As per the postings on FB the student was suspended "for causing a disturbance", that "disturbance" was his being bullied. It is disgraceful that the school wouldn't protect a student from being bullied but instead chose to punish him. It's like gay tourists visiting Jamaica being bashed then going to the police to file a complaint and then being beaten by the police.

With regards to his not being able to afford a lawyer, I'm sure that your correct since he apparently did the porn so that his mother wouldn't lose their house. Hopefully the ACLU will take up his case.

Though his actions do not constitute the "political" speech the framers intended, the 1st amendment covers pornography. Assuming he is 18, he has done nothing wrong and should be given his diploma provided he completes his coursework. At this stage, the school should be held responsible, along with associated politicians, for failing to provide a safe work environment for the student. That said, I get that what he has done to earn "lunch money" reflects poorly on the school and warrants some type of punishment. At this point, refusing to allow him to march in graduation and sending him his diploma in the mail would work for me. It could work for him too. This sordid tale could make him interesting enough to admit to Harvard or Yale!

Why should the school punish him? What he did was legal.  How does does reflect poorly on this wonderful school? Get real!

actually the school has zero right to punish him.  he violated no rules in school, did nothing wrong on school property or during school hours.  you are correct about porn being protected ... actually a very famous case ( the people vs. larry flint).  they are imposing personal morals on him to punish him and thats not how it works in our system of govt.  that is the entire basis of the first amendment.  a popular saying among constitutional jurists is "your rights end where mine begin" and vice versa.  this may have been an unforeseen application but its exactly the situation that was to be protected against. 

I don't get why the school should have ANY grounds to "punish" him for doing something legal on his own time off school grounds.  It's porn--it's a legit job.  it pays, it's legal.  Maybe some people don't agree with it, but some people don't agree with plastic surgeons, or soldiers, or abortion doctors, or a wealth of other professions.  They are still legal professions, and the school has no grounds or reasoning to punish him in any way for doing something legal.

It doesn't sounded like he outed himself and told people that he was doing porn...so someone found out and outed him.  Although he is responsible for his actions, he was of age, and should be given all the protections and rights afforded to him by the Constitution and by the school system.  The school is failing as are we.  I hope he gets a good lawyer!

Apparently, Sean Cody is the name of the porn company.  I don't know the name of the young man who played "Noel," so please replace "Sean" with the name of the "porn star" in my comment.

Bravo to Sean!  He is a courageous young man.  He should get the ACLU involved and sue the school's principal as well as the district.  This is a rather extreme injustice being perpetrated on this young man for his activities irrelevant to the school environment. This is also an opportunity for the other students to protest; however, will more than a few do that?  It seems unlikely considering, as described, the religious makeup of the community.  A lot would change in this world if more people were willing to stand up and protest in the face of injustice.   Good luck to Sean.  I hope he wins this battle for the sake of the entire school community.

I'm also appalled at the self-identified gay and lesbian who are unsupportive of Sean.   There has always been a raging battle in the gay community between those who think that hiding and not offending anyone is the best approach to gaining civil rights, and those who believe that being "out" and acting as normal people in the world is the best approach.  History has proven which strategy has been more successful.  Sean chose to not hide.  I think that it's ironic that today, MLK Day is the day we're having this discussion.

It is none of the education system's business what he does legally on his time out of school. He was suspended because of a disturbance that was caused by those who bullied him. By the sounds of it he is completely innocent and the fact that they suspended him long enough, knowing they would count his suspension as an absence, to fail him is clear discrimination. It is not about whether it is moral for a high school student to be doing porn. Maybe he wanted to do it, maybe he was obligated due to financial reasons, his reasons are his own and private. Its none of anyone else's business to judge him for it. He should sue the school for his diploma and some damages.

I'm sorry, but I do not believe that the people who own and cast at Sean Cody should have hired a high school student. It is both morally and ethically wrong. Do you know any 18 year old high school students? Most are not all that mature in the scheme of things and still need guidance. Yes they are intelligent, they can have a fresh outlook on life, and yes they may be eye candy and technically legal, but they are kids.Perhaps I am sexually repressed as one commentator suggested and perhaps there is not such thing as morality and ethics as another suggests, but there is one thing I have not forgotten, an 18 year old high school student, repeat high school student, because a greedy pornographer took advantage of a kid who probably did not know better may very well have ruined his life. Ed B.  Everything you say may be true, although I don't buy it.  You say that most 18 year old high school students aren't that mature and need guidance, but they are perfectly fine to send overseas into battle?  

Whether or not there is a moral or ethical issue to an 18 year old doing porn isn't the point.  The fact that "Noel" was suspended from school, either for doing the porn or for a "disturbance" issue from being bullied in school is the issue.  If it is the former, then it never should have happened.  He is of legal age, and was performing off of school property.  If it is the latter, then the bullies are the ones that should be punished, not "Noel".  "Noel" needs to have a lawsuit against the school district, and the principal needs to be removed from her position.

So what, exactly, is going to be the major growth in "judgment" between the day before he graduates high school and the day after he graduates high school.  At want point, oh purveyor of all that is intelligent and moral, WILL he be of sound mind to make his own decisions about what he does as an adult.  18 and a half?  19?  25?  40?  60?  I know people in their 40s who I consider FAR from mature, and people who are 18 who i would trust to make decisions long before some of my own peers.  Morality is subjective--you think this is immoral.  Good for you--then don't do porn.  He apparently doesn't have an issue with it, and in 2014, it's not exactly the detriment to his career and future that it once was, except, of course, for people like you who prefer to be judgmental and dictate what you think other people ought to do with their bodies when they are of the legal age to make their own decisions about it.  Really not your business, honestly.  Who would you like to make YOUR personal decisions for you?

The real question is whether he is 18 or not.  If he is, more power to him!  If not, then the school have an opinion, but even still, then it's a personal matter between he and his guardians.

If he is 18, then it's his business alone, and not the school's.  If he's under 18, then he's actually the victim of a crime, and the school still has no business suspending him. 

As a public school administrator myself, I cannot see a reason why this student would be suspended for 10 days for actions that occurred out of school.  There are times when two students start fighting online using twitter or other social media, which then continues in school the next day.  Then, when the fighting continues at school, administration often have to get involved and discipline is usually required.  This, however, is something completely different.  I'm sure that there are more facts missing from this story, but even still, I cannot see a suspension for causing a "campus disturbance" by actions that were done completely outside of school. I agree with other posters - what was done to stop the bullying?  Where were the school counselors and other administrators?  I can't see the school district winning this one in court at all.     

I wanted to add too, for those here who seem to have gone to private schools. In many a public school, there is no requirement for a student to sign any "Code of Conduct".  

James Harris hit the nail on the head.  One's personal morality - or a judge's, or a school administrator's (remember this is a public school!) - is not the issue. The question is a legal one. The school seems to have had no leg to stand on.  Doing porn while of legal age has nothing to do with academic performance. 

As for those here suggesting that he has somehow ruined his life and future for appearing in a gay porn scene or two - I work in mass media and have come into contact with gay porn celebs and directors; I know several personally. It does not carry the stigma that it did even 10 years ago. This doesn't have to follow him at all. The only thing that made me wince was that it was with "Sean Cody" - which even in the gay porn world carries a rep for questionable ethics. 

He did not break any laws to be suspended.  He should sue on the grounds of discrimination and in regards to the schools failure/refusal to protect him after he reported the bullying (which is a bigger crime on the schools part).

Why should he just "cut his losses" when what's being done ot him is discriminatory and possibly even illegal?  Would you suggest that someone whose house was broken into a robbed simply "cut their losses" rather than go to the police?  This type of behavior on the part of the school is completely out of line and wonrg. 

I'm a lesbian and I have to agree with the school. There is no legitimate reason for a teeanager to participate in pornography. Once he graduates and is 18, then he's free to do as he pleases and if he can make a living at it, then he has my blessing, but he should understand that he's just about screwed himself forever from ever getting a decent job and your looks don't last forever.

Stephanie, you are assuming that the young man in question is a minor.  The article indicates that he is of age, so that moots your first line of argument.  The other, more concerning, issue is your implicit Andrea Dworkin/Catharine MacKinnon prohibitionist view of pornography, which is legal to make and consume in Florida.  Your position is paternalistic and right-deviationist, denying as it does the young man's legal autonomy and his agency, and confers upon the school a legislative power that is beyond that which the law confides to it.  In short, you support the school because you don't approve of porn, even when made by gay men for gay men.  Again, your position is sex-negative, Victorian, and right-deviationist.

Congratulations on your lesbianism, but it doesn't preclude the fact that you're being short-sighted, sex-negative, and imposing your own sense of morality onto someone else.  He partook in a legal activity on his own time off school grounds--it's not the school's business.  This si no different than those schools that use to expel or suspend girls for being pregnant on "moral grounds."  The school has no legal standing to do this, and he should sue them to the end of reason.

As I said in a previous post, I live not far from this high school and I know the people and this school board and the court system up to the appellate courts. If this kid sues, he won't find any remedy until he's well into his 30s, I promise. Any lawyer who takes this case in this area will charge him close to $100,000 just to get started and this kid doesn't strike as the sort who has that sort of money. The lawyers know this case is a lost cause. If you're speaking from any other place but Florida, don't presume to tell me or anyone else from this area just how good or bad things are, because you really have no idea. We still have Saturday night cross burnings by four chapters of the KKK in Brevard County! That's the same county where Cocoa High School is and where I live (but wish I didn't)! First off young does not equate to naive we have all had our different experiences, no age group shares a collective knowledge base equating to superiority. maturity from someone who actually studies human behavior or sociology; is the point in time where the person stops reaching for goals and ideals and settles when one becomes complacent with there lot in life. much like physical maturity it is the point in which you stop growing. this is not inherently good or bad someone who hasn't reached this point looking at someone whom has reached this stage might think " that person gave up or is to much of a coward to chase after there dreams" while the "mature" individual will look at the other and think "they need a does of reality, or they need to grow up." While i understand your perception of the world around you, try to understand that others perception of there realities might differ (they may actually believe in there ability to change things). whether that is true or not is based on an collection of choices and outcomes that no one can predict. The number one problem we have today is not following or respecting rules. What did he think was going to happen? I live in the same county as this kid and I know Cocoa High School! They're mostly horse ranchers and farmers families that go to that school and almost all of them are right-wing Christians! Do you think that posing nude and attending a redneck high school will have him be welcomed with open arms? We aren't discussing what's legal or whether he could do it, because obviously he could. hmm so is that to say do not use morality and good judgment out of high school? and whose good judgment and morality would be in use. clearly the 18 year old individual made his own judgment as he should based on his own morality. naturally we judge other physically to sense out danger, prospective mates and what not( instinct), but once you decide that your own morality supersedes that of another you step on their right to the pursuit of happiness.
