As announced yesterday, the Ninth Circuit made a filing in the Prop 8 case, and, also as suspected, it dealt with the request by proponents for the Court to hear the case en banc.

The American Foundation for Equal Rights has broken the news that the Ninth Circuit is set to make a filing in the Prop 8 case tomorrow.
On Tuesday, we will likely find out if the Prop 8 case goes back to the Ninth for a full en banc review by 11 judges or if the request is denied. Should it be denied, Prop 8 supporters will likely file another request that sends the matter of to the Supreme Court.

Bruce Harris, the African-American openly-gay Republican mayor of Chatham in New Jersey, narrowly missed appointment to New Jersey's Supreme Court.
Democrats voted against his nomination citing his lack of courtroom experience and his willingness to recuse himself in court cases dealing with same-sex marriage.

Good news! Maryland’s highest court ruled Friday that same-sex couples can divorce in the state even though Maryland does not yet permit same-sex marriages.
Yes, we know it’s weird to be excited about divorce, but this decision on the part of the court shows clear recognition of same-sex marriages by the state, even though same-sex marriages aren’t currently legal in Maryland.

Three of the seven Iowa justices that unanimously decided that an Iowa law banning same-sex marriage was in violation of the state's constitution, were presented with the John F. Kennedy Profile in Courage Award on Monday.
Former Iowa Chief Justice Marsha Ternus and justices David Baker and Michael Streit were voted off the bench as a result of their historic decision.
