The Obama administration's amicus brief, filed last week, shot down what's being described as a "key" argument on the part of congressional Republicans in the Supreme Court's Defense of Marriage Act case.
Lawyers defending DOMA on behalf of Congress argue that because same-sex couples cannot become accidentally pregnant, they do not need access to marriage.

Four former U.S. Senators, each of whom voted in favor of the Defense of Marriage Act in 1996, now regret that decision, telling the Supreme Court that "the original justifications for DOMA can no longer be credited today," and concluding that "our constitutional commitment to equality does not tolerate such discrimination."

The Obama administration's brief asking the Supreme Court court to overturn California's Prop. 8 makes some interesting legal arguments.
While it doesn't go so far as to call for marriage equality across the country, it does make the claim that any state that currently allows civil unions should, in essence, be legalizing same-sex marriage in order to avoid a "separate but equal" standard.
