SCOTUS Justices Met With Anti-Gay Leader

So… they’re not even trying to hide their corruption anymore? Alarmingly but not at all surprisingly, Supreme Court Justices Brett Kavanaugh and Samuel Alito recently had a meeting with the leader of the extremely homophobic group, the National Organization for Marriage (NOM) and even posted a picture of the encounter on Twitter, showing the world what side these Justices are on, according to Above The Law.

If you’ve seen the Kavanaugh hearing that took place last year, you know that Brett Kavanaugh seems to be incapable of being bipartisan as he blamed the Democrats and even Hillary Clinton for the accusations against him, so it’s not at all surprising that he would meet with someone with no moral scruples (or at least very misguided ones). That’s one thing. One horrible thing, but still mild in comparison to what I’m about to tell you: NOM recently filed amicus briefs in the Bostock/Altitude/Funeral Homes cases that are currently being reviewed by the SCOTUS right now.

Because anti-discrimination laws necessarily infringe on individual liberty, on freedom of association, on freedom of contract, and even, as these cases demonstrate, freedom of speech, freedom of religion, and privacy rights, the basic policy determination to expand such laws to new contexts and new classifications is a power our Constitution assigns to the Congress, not to unelected and largely unaccountable bureaucrats and not even to the courts.

The Justices are still working on their opinions of those cases at the moment, so having two Justices meet with the leader of the group that filed the amicus briefs is not only unethical but completely unacceptable to anyone who values fairness in the law. Would this be acceptable in any other court of law? No. So why is it acceptable for the SCOTUS? Because the Supreme Court doesn’t have a code of ethics that the justices must follow, which seems like a gigantic oversight to me. The Supreme Court has the power to make anti-LGBT discrimination legal across the entire United States if they do so choose and meeting with someone who is involved with this issue, whether directly or indirectly, to sway the vote seems very biased to me and hopefully everyone else, so this meeting is very clearly an ethics violation that shouldn’t be tolerated.

Logically this seems very cut-and-dry. If a Supreme Court Justice meets with the leader of a group that filed amicus briefs to the SCOTUS, they should recuse themselves from the case related to the brief. But will they? Probably not. This very public display of corruption sickens me.

And people need to speak out against it.

  1. The Supreme Court does not reflect the makeup of the citizens of the United States when it consists of six Catholics (or former Catholics) and three Jewish justices.
